Transmutation In General

A transmutation occurs when the contributing spouse evidences his intent to make a gift of the non-marital property to the marriage by significantly changing the character of the property to marital.  In re Nicks, 177 Ill. App. 3d 76.
The principal of transmutation is based on the presumption that the owner of the non-marital property intended to make a gift of that property to the marital estate.  In re Benz, 165 Ill. App. 3d 273.
