State Agencies & Child Support
(A) Public Aid: recipients of state assistance are required to assign their right to child support to the program from which they derive the assistance.
(1) That state agency then assumes the enforcement of the obligation in an effort to reimburse the state for its payments.
(2) Case law also holds that Public Aid can provide child support enforcement even to those individuals not receiving assistance, based on the fact that they are still serving a public purpose.
(B) State Disbursement Unit (SDU): Since 10/1/99 the SDU has been collecting and disbursing payments made under court order in all cases in which support is paid under the Income Withholding for Support Act.
