Office Procedure After the Prove-up Hearing is Scheduled
After scheduling the prove-up hearing, first you must record the date in the main black calendar to ensure our appearance at the prove-up. Since it is essential that our client is present to offer the testimony needed to establish that the legal requirements have been met, the client needs a letter informing them of the hearing date. Notice is also sent to the responding party that we will be seeking a judgment that day. Notice to the respondent is important because until the entry of the judgment the respondent has an opportunity to change their mind.
In order to have these letters sent, we need to prepare the half-slip provided by the clerk (in instances where no slip is received put the information on the outside of the folder) to give to our support staff to draft the letter. First, you need to circle the date and time of the hearing. Second, write out the day of the week on which the hearing is scheduled (i.e. Monday, Tuesday, etc.). Third, write the courtroom that will hold the hearing (usually you know this from when you scheduled the hearing or you can discern the information from the calendar it is assigned to and the day the hearing was scheduled). Finally, write the balance that is due in court (only Cook cases) and paperclip the half-slip to the folder. Then, give the file to the support staff to complete the letters. For Lake County and other counties, when applicable, the support staff will also complete the Motion for Default and send it out along with the letters.
