Preparing the file for a Prove-Up
The day before the prove-up is held, the file needs to be prepared. In Cook County, additional documents are needed at the prove-up hearing. First, the 28 day transcript order must be prepared. The file should already have copies of the proposed judgment and agreements. Second, prepare the court reporter sheet, judge’s information sheet, if needed, and the free transcript order, if needed. Third, prepare any relevant support orders. Finally, prepare a prove-up guide or review your judgment so that you are aware of the grounds, relevant dates, and issues involved. (See attached.) You also want to be sure there is a folder to give to the client.
In all other counties, the file needs to be reviewed to complete any support orders necessary in the case. You also want to be sure there is a folder to give to the client and that there is enough copies of the proposed judgment and settlement agreements are in the file. If you are in Lake County and the case involves minor children, be sure the UCCJA form has been completed and signed. If you are in Will County and child support payments are direct and not through the SDU, be sure the waiver of SDU has been signed by both parties. Finally, prepare a prove-up guide or review your judgment so that you are aware of the grounds, relevant dates, and issues involved. (See attached.)
