Prove-Up: The Finalization Process
PROVE-UP - THE FINALIZATION PROCESS
The final stage of a divorce where the parties have reached an agreement or the respondent is in default is called a “prove-up.” A prove-up is a short hearing before the judge. In this hearing you are establishing with legal evidence (usually your client’s testimony) that all the legal requirements have been satisfied such that you are entitled to a judgment. From the very beginning of the uncontested divorce process, you are beginning the foundations for this final step. The judgment and attached agreements sent to the client for signature are the first steps to presenting the proposed final order before the court. Once you have obtained the signatures needed and the case has been filed with the court, you are now ready to set the case for the prove-up hearing.
