Setting A Prove-Up Hearing
1. Stipulated Case in Cook County
Immediately after filing the case, the case can be set for the prove-up hearing. First, you must complete a motion slip (usually the most of motion slip is prepared in advance by the Support Staff). In order to complete the motion slip, you must have the case number, the case calendar, and the preferred date and time of the hearing. Second, the Certificate by Counsel that establishes the case as a stipulated case, which is signed by the attorneys and the parties, is presented to the clerk along with the motion slip when filing the motion. The clerk files the Certificate with the case and schedules the hearing. The clerk will provide you a half slip indicating when the prove-up was set.
2. Default Case in Cook County
In Publication cases, you cannot schedule the prove-up immediately after the case is filed because the case is not ready for prove-up. Service to the respondent must be completed by publication before the case can be set for a prove-up hearing. It is entirely possible that the respondent may become aware of the case through the publication and want to be involved in the case. Any new filings where publication is not free must be given to Dave to submit the case to the publisher. The publisher provides the court a certification of the publication once completed. Then, after the publication period ends the attorney must review the court file and certify that no appearance was filed in the case using the Certificate and Motion for Default form.
When the publication period has ended, the case is ready for the prove-up to be set. Similar to the stipulated case, the motion slip must be prepared for the clerk. However, instead of the Certificate by Counsel and you present the Certificate and Motion for Default form. In addition, you must request the court file and bring the court file to the motion clerk. The clerk will set the prove-up and provide you with the same half-slip. After the motion is set by the clerk, you return the court file.
3. Default or Stipulated Case in Lake County
After the case is filed, the file is brought back to the office. If it is a Publication case, we wait until publication is completed (the file should be given to Dave to submit the case to the publisher). If it is a stipulated case, then we are ready to set the prove-up.
First, you contact Gwen, a clerk, at 847-377-3268. You usually leave a message and then she returns the call. You coordinate with Gwen the date you want the case heard. Only 2 prove-ups per counsel can be scheduled on any day of the week except Thursday. The hearings are always scheduled for 9:00 am in Room 107. Now your prove-up is scheduled. Next, follow the Office procedures below.

After the case is filed, the file is brought back to the office. If it is a Publication case, we wait until publication is completed (the file should be given to Dave to submit the case to the publisher). If it is a stipulated case, then we are ready to set the prove-up.
First, you contact the Motion clerk, at 815-740-8015. You provide the case number to the clerk. The clerk will advise you of available dates in which the prove-up can be heard and the Judge that will be sitting that day. This prove-up hearing cannot be held within 30 days of when the case was filed. Pick an available date that coordinates with our schedule. Now your prove-up is scheduled. Next, follow the Office procedures below.
5. Default or Stipulated Case in Will County
After the case is filed, the file is brought back to the office. If it is a Publication case, we wait until publication is completed (the file should be given to Dave to submit the case to the publisher). If it is a stipulated case, then we are ready to set the prove-up.
First, you contact Divorce secretaries at 630-682-7176. You provide them your case number and the attorney code is #22470. They will advise you of which Judge the case is assigned and the available dates to have the prove-up hearing held. Pick an available date that coordinates with our schedule. Now your prove-up is scheduled. Next, follow the Office procedures below.
