Waukegan Divorce Lawyers Utilize The Uniform Order For Support

In the Circuit Court of the Nineteenth Judicial Circuit, located in Waukegan, Lake County, Illinois, Waukegan divorce lawyers must utilize the Uniform Order For Support. This Order For Support applies to Waukegan divorce cases as well as to Waukegan Parentage cases. The Order satisfies all of the requirements mandated by the Illinois Marriage and Dissolution of Marriage Act.

For example, the Order identifies the parties and indicates whether or not the Order is the Initial order or Modification of a prior Order. The Court makes findings pertaining to the net income of the obligor (person paying support), whether or not there is an arrearage in support and whether or not the support is for child support, maintenance or unallocated support. Regardless of the type, the payment amount and payment frequency will be itemized with great specificity. In some case, the amount of support will be depicted as a percentage.

The Order also specifies the payment arrangement. It can be paid directly from the obligor to the obligee or it can be deducted directly from the obligor’s wages, forwarded to the State Disbursement Unit and then forwarded to the obligee. If you are in doubt as to whether or not the obligor will make timely payments, elect for withholding and have the support taken directly out of the pay check.

There is a section for delinquency which is in addition to the support amount. In the event of a delinquency, the repayment amount can be no less than 20% of the total current support amount.

The section called Termination is utilized to end the support obligation. This date is typically the date when the youngest child reaches the age of eighteen or when the child is expected to graduate from high school, whichever occurs later.

Medical insurance is depicted indicating who is to provide such coverage, the extent of the coverage and what percentage each party must pay for uncovered medical expenses.

Lastly, the parties’ information is listed, including each Waukegan divorce lawyer who was a party to the case. Further, the address, telephone number and attorney registration number for each Waukegan divorce lawyer will be itemized at the end of the order. The final page is a child support data sheet which can be attached or omitted depending upon the decision of the Judge.
